Supreme Court Year in Review

I have a few further thoughts on the health care decision. Are they too late? I've never entirely grasped the format of our discussion; the mention of breakfast particularly baffles me. And maybe when the court ends its term, the discussants, like the participants in the trial of the Jack of Hearts at the end of Alice's Adventures in Wonderland, turn into playing cards and are scattered to the winds. But anyway, here are my further thoughts:

Professor Dellinger said in reference to the health care decision: "What is most important today is not constitutional theory or presidential politics, but the enormous improvement in access to health care for millions of Americans, including increased access to preventive care such as mammograms and birth control, provisions allowing young people to stay on their parents' health insurance, provisions prohibiting insurance companies from turning down people who have pre-existing conditions or from increasing premiums to unaffordable levels for families who have a child born with a birth defect. Those are the most important winners today." I don't agree. I am pleased that the Supreme Court upheld the law, but I don't think it's a good law.

The Washington Post has an excellent economic journalist named Robert Samuelson, and he had a column a week or two ago in which he persuasively criticized the law. There are three basic criticisms. The first is that it is so long and complex that actually no one knows what its consequences will be. It was an irresponsible enactment. Second, it was very badly timed. Creating economic uncertainty is the very last thing one wants to do during a depression, because, as Keynes argued, it is uncertainty that deepens a depression and retards recovery from it, because a rational and extremely common reaction to uncertainty is to freeze. The health care industry is the largest in the United States, and the law was bound to affect the costs of medical care (which of course include health insurance premiums) for business and for people in the labor force (whether employed or self-employed) in ways that could not be forecast. I know one is supposed to call the economic malaise in which the nation is sunk, which in a couple of months will be four years old, the "Great Recession," but I call it a depression. It is not as severe as the 1930s depression, yet it may have as profound economic and political consequences. It merited and did not receive the full attention of government.

Third, the law will increase health care costs, and hence the federal deficit, which is already staggering. I agree with liberal economists that the current deficit, though huge, is nothing much to worry about, because of the extremely low cost at which the U.S. Treasury can borrow these days (thanks to Europe's economic distress and lack of private demand for loans), even long term. I agree that the stimulus of February 2009 should have been larger, with the government borrowing heavily and using the borrowed money to finance projects that would employ lots of workers. But the deficit cannot be allowed to grow indefinitely, and the health care law will help it to grow indefinitely. There is no way the nation can add 30 million people to the private or public health insurance rolls without experiencing higher health costs. The reason is that insured people demand and receive more health care than the uninsured. That is explicit in Professor Dellinger's reference to health costs that are "unaffordable" by the uninsured. The care they will now get may improve their health. They may live longer. But the longer people live, the more medical care they need.

I think the best one can say for the law is that it has drawn attention to the manifold problems of our health care system. As a result, or partial result, of the law, some modest improvements, such as recommendations against excessive screening for rare medical problems, are in the works, although they will be resisted by most doctors, especially specialists, who are most doctors nowadays. But I think any cost savings that ensue will be swamped by the 30 million new eager health care consumers.

All this is germane to the Supreme Court's health care decision because if the court had wanted to make "policy judgments," it could have had a field day. Chief Justice Roberts in his opinion said that that's not the Supreme Court's business. A legal realist would say that most Supreme Court decisions in constitutional cases are policy judgments?inevitably, because of the Framers' and ratifiers' inexplicable failure to peer into the future and observe 20th-century American society. Where was their foresight? (I hope readers understand the sarcasm.) I think Roberts was quite right to say that "we [the Justices, but it is true of the entire American judiciary] possess neither the expertise nor the prerogative to make policy judgments." I would emphasize lack of expertise as a general problem of the American judiciary. But policy judgments are inescapable when dealing with the Constitution, and I think the best interpretation of what the court did in its health care decision was to make a prudential judgment to allow the law to stand, a judgment that I imagine is based to a significant extent on the hammering the court would have taken had it struck the law down. And, to recur to Samuelson's concern, the uncertainty created by the law would have been compounded rather than dissipated by its invalidation, because of uncertainty as to how Congress would respond, given the popularity of provisions (insurance for pre-existing conditions and coverage of kids up to age 26 by their parents' health insurance) that the mandate is intended to finance and that would have gone down the drain had the dissenters had their way, and because of the further fact that many health providers have already taken steps to comply with the law, and undoing those steps would be costly and confusing. A Donnybrook was averted.

And speaking of dissenters: Would they have had the courage of their convictions had they been able to pick up a fifth vote? Or would they have been like the dog that barks ferociously when it's behind a fence, but open the gate and it slinks away timidly?

The Downstairs
When you walk into the house you enter into a mud room but to enter the and leave the house there is a lock system in which you have to type in a code in which the staff are the only ones to have it. You walk into a hallway to the right there is an open doorway that goes into the kitchen, which has all cupboards locked up to all the patients, its a large room with the kitchen things on the left and to the right as a large table that has 13 chairs. Off of the kitchen is a room that is locked and can only be opened by staff, Patients where never allowed in this room. This was the staff/med room, this was where the staff kept their things and where the medication was locked up, it also had a small bathroom off to the side.

Back into the hallway on the left there are two doors. The first one was to the living room, in the living room there was two couches and two chairs with a tv on the wall with a small shelving with videos and dvds but they are locked up. There was a bookshelf filled with books and a table with a couple chairs. The next room was the activity/day room. This is where most groups and group activities will be, it had a few tables with chairs in it, a shelf with doors that is locked that has different games, activities, and crafts. The stairs are off of this room. The last room is the Treatment room, which is at the end of the hallway and locked, this is where the therapist and doctor meet with each patient during the day.

The Upstairs
When you go up the stairs you first go into a hallway, to your left is the Nurse's room, which is locked, the Nurse lives there 24/7 and have a bathroom connected to it. Next to the nurses room is another hallway that has two rooms which are lockable, these are the safe rooms. Their is one for the girls and one for the boys, the safe rooms are used when a patient is either being a danger to others or themselves. The rooms are bare of anything and actually has padding all around it, there is a light on the ceiling that is actually in a cage looking thing.

Back in the hallway across the hall is the hallway to the bedrooms. The girls on the left and the boys on the right, the rooms start at Girl 5 and Boy 5 and goes down, the first three rooms on each side are found with a bed, nightstand, closet cupboard and dresser. The last rooms are shared by patients girl 1 & 2 and boy 1 & 2, they have two beds, two dressers, two nightstands and two closet cupboards. The bathrooms are found back if you go back out in the hallway and at the end of the hallway you take a left, the boys bathroom is the first room and the girls bathroom is the last room.

Here?s the trick, here?s the ?skinny:? If you love a particular line or phrase, if you?re coddling a particular scene or character, then you have to give these prized precious things a nice shove?into rush-hour traffic. Kill these things, swiftly, with no remorse and move on.

It is in human nature to protect something or someone you love, but as a writer, you are truly doing your writing a disservice by holding on to it indefinitely. It has been a hard lesson for me to learn, but I am learning it, however slowly.

A trick I play on myself occasionally is ?opposite day.? If my first instinct is to give a character a night off, some warm milk and a night in front of the television, then my opposite day instinct is to have the character be car-jacked and mugged and thwacked on the head, metaphorically speaking. And those moments when I actually force myself to do those things to my ?pearls? of language or characters, I always get something better than I could have imagined. My results are always a pleasant surprise.

But it is also human nature to fight change, and that?s why it?s taken me so many years to even admit that often I horde my precious words and sometimes, only sometimes, do I try to break free.

For cleaner laundry, add diamonds

Laundry detergent laced with teeny, tiny diamonds removes fats and dirt at lower temperatures than the blingless variety, according to new research.

The nanodiamonds -- pieces of carbon less than ten thousandths the diameter of a human hair ? were added powder detergent to see if they could scrub out grime that typically requires hot water cycles to remove.

?We found that the 5 nanometer diamonds changed the way detergents behaved at 25 degrees centigrade (77 degrees Fahrenheit), doubling the amount of fat removed,? Andrew Marsh, a chemist at the University of Warwick in England, said in a news release.?

?Even at temperatures as low as 15 degrees centigrade (59 degrees F), otherwise hard-to-remove fat could be solubilized from a test surface.?

Without the diamonds, water temperatures between 60 and 90 C (140 and 194 F) are required to get such stains out of laundry.?

The lower temperature water afforded by the bling, the team notes, should help people save on their energy bills. Of course, they may have to spend that savings on the pricier detergent.

The research appears in the journal Applied Materials and Interfaces.?

Sunset League Baseball | Newport Sports & Recreation Events on ...

Considered one of the oldest ballparks in the U.S., Cardines Field is a popular complex in the heart of Newport. It is the home of the Newport Gulls baseball team.

Formerly known as "the basin," it was used in the 1800s as a source of water for steam locomotives. In 1908, a small group of railroad employees cleared the space for a baseball diamond. In 1936, the city purchased the field. In the 80's, it was at risk of being torn down to make way for a parking lot. But it is now well-maintained, in part thanks to the "Friends of Cardines Foundation" and the work of the Newport Recreation Department. Cardines field underwent renovations in 2002.

Many baseball greats are said to have played there. Rumor has it that Babe Ruth even graced the stadium.

2011-2012 Legislative Session in Review ?

(June 27, 2012)? Following the past two years of progressive smart growth legislation including the Smart Growth Public Infrastructure Policy Act, Complete Streets and Land Banks, the 2011-12 legislative session proved slower for smart growthers.

The year started off strong with budget negotiations addressing needed increases in transit authority budgets upstate and downstate.? A ?fix? to the Tax Increment Financing (TIF) law, which if utilized appropriately could be a useful tool to finance infrastructure and economic development improvements, was also part of the executive budget bills.

Other good bills, or at least bills that are positive starts, are also awaiting the Governor?s signature.? A bill instituting a non-voting rider representative on NFTA?s board (S6536/A9455) passed both houses.? Rider representation was supported by New York Transportation Equity Alliance (ESF is a steering committee member) and is seen as a preliminary step in creating a voice for the transit-dependent riding public.

The Assembly and Senate also passed an increase to the New York?s Environmental Protection Fund (EPF) by more than $50 million over six years. Under the measure, $10 million from unclaimed bottle deposits would be added to the fund next year. That would increase to $20 million in 2014, $30 million in 2015, $40 million in 2016, $50 million in 2017, and $56 million in 2018.? ESF is a long supporter of dedicated revenue for the EPF which provides important dollars for environmental cleanup, parks, land conservation, smart growth, among other programs.

A bill increasing the cap for the Historic Preservation Tax Credit from $5m to $12m also passed both houses.? The bill, which allows for retroactive payments to developers who have conducted a historic preservation project since the beginning of the program in 2009, does not address the impending expiration of the program in 2014.? ESF hopes to see a long term solution to continue this program, which has been so valuable in our historic urban and town centers.

A few bills that we also followed did not cross the finish line.? A NYS solution responding to the failure of officials in D.C. to continue to offer equal benefits for transit riders as to what is offered to drivers that park (S2728-C/A 6175-B), passed the Senate but died in the Assembly.? An expanded statewide transit funding lockbox bill (A9017-A/S6170-A), which would have strongly discouraged raids on dedicated transit funds by requiring a ?diversion impact statement? whenever taxes and fees created to fund public transit were spent for other purposes, also stalled. Lastly, the Solar Jobs Bill couldn?t make it across the finish line.

As summer heats up, Empire State Future will once again focus on the Regional Economic Development Councils, now a proven tool in some of New York?s regions to advance smart growth goals.? Funding for the second round includes $220 million ($150 million in capital and $70 million in tax credits from the Excelsior Jobs Program) to implement regional strategic plans and support priority projects, and up to $530 million from state agency programs through the CFA to support regionally-significant economic development projects.? A tiered approach will promote the regions who were awarded ?Top Plan? status in 2011 to continue to work towards implementation of their strategic plans.? The remaining regions are setup in a separate competition for funds that motivates continued work towards advancing priority projects and revisions and updates to their strategic plans. ?ESF will continue to make the case to include smart growth language in strategic plans as well as investments in and around transit served communities.

We will also monitor the recently announced Cleaner, Greener Communities Program which has tasked each region to develop a region-wide sustainability plan to complement the strategic plans developed last year.? Following completion of the planning process, $90 million of Regional Greenhouse Gas (RGGI) funds will be available to fund smart growth and pollution reduction goals.

And lastly, ESF will continue to engage with the New York Works Task Force, a fifteen member panel tasked with recommending priority infrastructure projects throughout the state. ESF wrote earlier this year that to get NY to Work, we must look beyond the Regional Economic Development Councils and focus on prioritizing our infrastructure spending to create jobs and foster economic growth in New York.? The task force, which held their first meeting in early June, will be tasked with finding innovative ways to finance, build, and maintain the new and existing infrastructure that will drive economic growth in New York in the 21st Century.? As more pressure will surely arise to utilize new methods of public private partnerships and debt-financing to get projects moving, ESF will continue to call for the attention on projects that promote equity, prioritize sewer and water in existing urban areas and transit infrastructure, which has proven worldwide to be engines of growth.

While on paper the 2011-2012 legislative session may have been slow, important opportunities exist for local smart growth advocates to make their voices heard through the regional sustainability plans, land bank efforts, regional economic development councils and at local planning and zoning boards.?   • "Kitchen Nightmares"

Though the reality series underperformed in its Saturday night timeslot, it's not Fox's decision whether or not we'll see more "Q'Viva."

  • "Raising Hope"

    <strong>"So You Think You Can Dance," Fox</strong><br /> <strong>Status: </strong>Too soon to tell<br /> <strong>Why:</strong> Season 9 of "So You Think You Can Dance" won't debut until this summer and when it does, there will be changes: Fox has nixed the results show entirely. If the fanbase is still there, the cheaper production could save the show for another few seasons.

  • "Terra Nova"

    <strong>"Terra Nova," Fox</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Fox pulled the plug on this very expensive dinosaur drama, but reports indicate producers are looking to keep the show alive on a different network.<br />

Fox showed faith in the series, giving it the post-"American Idol" slot, and it paid off.

  • "The X Factor"

Cool, cool, cool -- you can pop, pop! that champagne now.

  • "Fashion Star"

    <strong>"Harry's Law," NBC</strong><br /> <strong>Status:</strong>Cancelled<br /> <strong>Why: </strong> While earlier this year "Harry's Law" was one of NBC's top players, after a three-month break between January and March, the Kathy Bates drama saw mediocre ratings and failed to hold on to viewers.

  • "The Playboy Club"

It will return for a Season 2.

  • "Whitney"

Looks like Season 2 is a good start, with the show moving to Friday nights.

  • "The Voice"
